Terms and Conditions

1. GENERAL
Chic Gîtes arranges short-term accommodation in Cannes for individuals and companies. Chic Gîtes is the trading name of SARL Helen, which is a company registered on the Cannes Chamber of Commerce Trade Books. The Property refers to the relevant accommodation offered under the Chic Gîtes banner, as specified in the confirmed booking by SARL Helen (which will henceforth be referred to as The Owner) and the renter (The Client).

2. BOOKING
2.1 Bookings shall only be considered confirmed upon receipt of a non-refundable deposit of 50% of the rental price along with a signed and completed booking form. This will be sent to you following confirmation of availability for your chosen dates. Please note confirmation of availability can only be given by the owner via email, phone or in writing. Availability as per the web site is for information purposes only and may be subject to change. A confirmed booking reserves the property until 4 weeks prior to commencement of rental when full payment is due. At this point we will send you a Booking Confirmation email. The person who has signed the booking form is responsible for initial and subsequent payments that arise and the compliance of all members of the party with the general rental conditions as specified in this document.
2.2 Bookings cannot be accepted from persons less than 18 years of age at the time of booking. We reserve the right to refuse any booking without giving any reason.

3. PAYMENT
3.1 The balance of the rental charge together with the security deposit (in accordance with paragraph 4 bis) is payable not later than 4 weeks before the first day of the rental. Failure to pay the balance on time will constitute cancellation and cancellation charges will become payable in accordance with paragraph 6. We currently accept bank transfers and credit card only. We do not accept cheques.
3.2 If you book a property less than 4 weeks before the arrival, the full rental charge is payable at the time of booking.

4. RATES
4.1 All prices given are in Euros.
4.2 Properties are let fully furnished and equipped. The price for all properties includes linen (see paragraph 14), welcome supplies and final cleaning services.
4.3 RATES INCLUDE:
• TAXES: Taxe de Sejour (local taxes) and TVA (Value Added Tax).
• HOUSEKEEPING before and after your stay.
• Meet and Greet at the apartment - in the case of late arrival, a welcome pack will be provided.
• 24h/day telephone assistance number.
• Basic apartment insurance except for guest luggage and valuables.
• Water, electricity and gas usage.
• Wi-fi, printing costs and cable television where available

4.4 RATES DO NOT INCLUDE:
• Services on request such as: fax, mobile rental, transportation, laundry, additional linen.
• Insurance for guests' liability, luggage, cash, and valuables: please contact your insurance agent before departure

4.5 WI-FI, CABLE TV & TELEPHONE
If a property states that Wi-fi is available, this is done so free of charge. Likewise if a property includes cable TV, it will be provided free of charge.
4 bis. SECURITY DEPOSIT
A security deposit of €500 for every week or part week of a rental period, is required to cover the cost of any damage or breakages that may occur. However, the sum reserved by this clause shall not limit the client‘s liability to the owner. The security deposit will be returned to you within one week of your departure (subject to banking delays) from the property less any costs. Delays may be caused while we are waiting to receive bills from providers. If you pay by credit card this amount will refunded to the credit card used to make the booking only.

5. ALTERATIONS OR CANCELLATION BY US
5.1 In the unlikely event that it is necessary to make an alteration to or cancel the temporary accommodation specified in the booking form, we will inform you as soon as possible and if requested, we will try to arrange alternative accommodation of similar or higher type and standard and in a similar location as that originally requested.
5.2 If the alternative temporary accommodation is not acceptable, we will refund in full all monies paid and shall be under no other liability than the amount paid at the time of booking.

6. CANCELLATION BY YOU
6.1 Any cancellation by you (for whatever reason) must be in writing. The effective date of cancellation is the date on which written notification is received by us in Cannes. We may, entirely at our own discretion, accept email or phone cancellations.
6.2 If you cancel at any time between receipt of the Booking Confirmation email and 4 weeks prior to your arrival date, you will lose your deposit in full. Any cancellation once the final payment has been made (4 weeks prior to arrival date) will result in the loss of the total rental fee unless we are able to find an alternative booking between cancellation and the arrival date. In this case only the initial deposit will be lost.
6.3 If you cancel or do not arrive at the first day of the stay (no show), or if you vacate the property before the end of the rental period , or if the booking is cancelled by us due to non payment, we shall be entitled to the full rental cost from you.
6.4 To avoid cancellation fees, we strongly recommend you to book only when your travel dates are firm and to ask your travel agent for cancellation insurance.
The client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party‘s personal belongings, public liability, etc since these are not covered by the owners insurance.

7. AMENDMENTS BY YOU
Upon receipt of your Booking Confirmation please check the details to make sure they are correct. If the day after your booking has been accepted you require us to amend it in any way or to re-invoice you, we reserve the right to treat a change of property and/or rental dates as a cancellation of one accommodation and the booking of another.

8. INFORMATION AND PICTURES
8.1 While we make every effort to ensure that description and picture are accurately reproduced, we cannot accept responsibility for errors contained therein or the results thereof.
8.2 You must accept that minor differences between the photograph/illustration/text used and the actual property may arise. Concerning element of comfort, decoration and furnishings, please refer to the written description of the page. Some details and equipment you can see on the pictures as flowers, candles, bottles of wine, some pieces of dishes or crockery etc are not necessarily provided.
8.3 The owners reserve the right to make modifications to the properties that are considered necessary in the light of operating requirements. In the interests of continued improvement, the owners reserve the right to alter furniture, fittings, amenities, facilities, or any part of any activities, either advertised or previously available, without prior notice.
8.4 If material changes occur after your booking has been confirmed we will advise you if there is time before departure.
Whilst all documentation and the website of Chic Gites has been intended to make representation as accurate as possible of the properties, no responsibility can be accepted for any differences or changes to that given,

9. ACCESS - ARRIVAL AND DEPARTURE TIME
The rental period shall commence 16h00 on the first day and finish at 11h00 on the last day. The owner shall not be obliged to offer the accommodation before the time stated and the client shall not be entitled to remain in occupation after the time stated. Check-in and check-out are AT THE PROPERTY, so please let us know your expected arrival time and we will meet you at the property with the keys. If you are delayed you must contact us on the number provided to re-schedule. If your arrival is expected to be after 21h00 the owner will contact you about details of obtaining the keys. The owners shall be allowed access to the accommodation at any reasonable time during any occupancy for the purposes of inspection and maintenance.

10. NUMBER OF PEOPLE USING THE TEMPORARY ACCOMMODATION
Only those persons named on the booking form may use the property without prior agreement. The maximum number of people residing in the property after 22h00 must not exceed the number of sleeping places indicated on the booking confirmation. In the event that the maximum number is exceeded without prior agreement, The Owner reserves the right to revoke the contract immediately and at its sole discretion with no refund payable.

11. PETS
The owners regret that pets are prohibited in all properties. Failure to comply will result in clients being liable for the full cleaning costs incurred and any subsequent loss of rental.

12. SMOKING
For the comfort of future guests and due to the nature of the apartments we regret that smoking is prohibited in all properties. Failure to comply will result in clients being liable for the full cleaning costs incurred and any subsequent loss of rental.

13. YOUR RESPONSIBILITIES
You must keep the property and all furniture, fittings, effects, facilities and equipment in the same state of repair and condition as at the commencement of the stay, and leave the accommodation in the same state of cleanliness and general order in which it was found. You are responsible for all damage or loss, which occurs to the property or its contents during your occupation, and will be responsible for paying appropriate compensation to the owners in the event of damage. In the case of a dispute over breakages, the owners decision shall be final.
The client agrees to be a considerate tenant and to take good care of the property and to leave it in a clean and tidy condition at the end of the rental period. Although final cleaning is included in our prices, the owner reserves the right to make a retention from the security deposit to cover additional cleaning costs if the client leaves the property in an unacceptable condition. The client also agrees not to act in any way, which would cause disturbance to those residents in neighbouring properties. Should you and your party not behave in such a manner, the owners may at its absolute discretion ask you and your party to vacate the property immediately without a refund of the rent.

14. LINEN & TOWELS
The cost of linen is included in all our rentals, but is advisable to take baby linen if needed.
Bath and hand towels are included in all properties but we do not provide beach towels.

15. PROBLEMS
The client shall report to the owners, without delay, any defects in the property or breakdown in the equipment or appliances in the property and arrangements for repair and/or replacement will be made as soon as possible.
In the unlikely event that you are disappointed with the property, you should contact the owners immediately so that they can try to solve the problem. If after that you still feel that the problem has not been resolved to your reasonable satisfaction you should within 7 days of returning from Cannes, contact us in writing.
If you vacate the property before the end of the rental period without our authorisation you shall lose any rights to compensation.

16. LIABILITY OF THE OWNER
The owner shall not be liable to the client:
a. For any temporary defect or stoppage in the supply of public services to the property, nor in respect of any equipment or appliance in the property.
b. For any loss, damage or injury to the client, family, friends or visitors to the property during the rental period
c. For any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the owner
d. For any loss, damage or inconvenience caused to, or suffered by the client, if the property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the owner shall, within seven days of notification to the client, refund to the client all sums previously paid in respect of the rental period
e.For noise or disturbance originating beyond the boundaries of the temporary accommodation or which is beyond our control.
Under no circumstances shall the owners liability to the client exceed the amount paid to the owner for the rental period.

17. PHOTOGRAPHIES
Photographs taken at our properties cannot be used or sold for profit without authorisation from the owners.

18. SOCIAL, BUSINESS, TRADE EVENTS AND OTHER FUNCTIONS
It is our policy, to allow only residential use and not to allow social, business, trade events and other functions (exhibitions, trade desks, weddings, receptions, large cocktail parties) on the property without prior agreement at the discretion of ourselves. If permission is granted an additional fee may be charged.

19. SECURITY AND VALUABLES
Any valuables left at the property are left at your own risk. The owners are not responsible for their loss.
Entrance door must be always locked with key(s) when you are outside the accommodation. Failure to comply may result in the client being fully liable for any resulting loss to the owners incurred. We accept no responsibility for any loss, damage or consequential losses due to theft or any other security related incident howsoever caused.

20. INSURANCE
Your belongings are not covered by the property insurance.
We strongly recommend you to cover yourself, every member of your party, your luggage and your party's luggage, cash, jewels, valuables, etc. by comprehensive travel insurance. Please contact your insurance agent or your travel agent before leaving your permanent home.

21. LAW
All contractual obligations arising out of these booking rental conditions shall be deemed to come into existence in Cannes , FRANCE , and be subject to French law and the exclusive jurisdiction of the Cannes courts.
Please note that these booking conditions will be included on our confirmation invoice/statement to be signed and returned at time of booking.
